1. Scope

These terms apply to the use of the CarDex app, offered by Pedram Panahi Olfat, Trockener Kamp 8, 31139 Hildesheim, Germany (“we”). We point these terms out to you when you first start the app and keep them available at all times; by confirming them at the start, you accept them.

2. Service

CarDex lets you photograph cars, have them identified by AI and collect them as trading cards in a digital garage. This includes game features such as the Car Duel and a global leaderboard. The app is an entertainment and collecting product. It is available for iPhone in the Apple App Store and for Android devices on Google Play; downloading it is free of charge.

• Take photos responsibly. Respect the privacy and personality rights of others.
• Do not upload unlawful, offensive or infringing content.
• Do not misuse the recognition feature (e.g. automated mass requests). We may limit the number of scans and put a stop to misuse.

5. Trial week, ad videos & CarDex Pro

Trial week

From the first start of the app, you can use CarDex free of charge with all features for 7 days: unlimited scanning (within the technical limits, see below), unlimited Car Duels, batch upload (several photos at once), higher-resolution photos, double base XP for every scanned car and a higher daily XP limit in the Car Duel (30 instead of 10 counted hits). The trial week runs continuously from the first start, including days on which you do not open the app. You need no subscription and no payment details for it. The trial week ends automatically and does not turn into a paid subscription. It is available once per device. From app version 1.4.2, “Delete all data” („Alle Daten löschen“) does not restart it. On iPhone, reinstalling the app does not restart it either, because the app stores the start of the trial week in the iOS Keychain (see Privacy Policy, section 7). If you set up a new iPhone from an encrypted backup of a device on which the trial week had already started, this entry may be transferred too; the trial week then also counts as used on the new iPhone.

Android: On Android devices, the app stores the start of the trial week encrypted in the private app storage (key in the Android Keystore). On Android, CarDex does not use the backup of app data to your Google account. Android deletes this storage when you uninstall the app; reinstalling it can therefore restart the trial week on Android.

After the trial week (without a subscription)

• Your garage with all collected cards remains yours and accessible permanently.
• Scanning is possible without a subscription via an ad video: one fully watched video unlocks one scan. You can do this as often as you like, with no daily limit. Unlocked scans do not expire.
• Car Duel: one fully watched video unlocks one Car Duel (one round until the first wrong guess), at most 3 videos per day. Unlocked Car Duels do not expire.
• Batch upload is only available during the trial week and with CarDex Pro.
• If a video is cancelled or not watched to the end, nothing is unlocked. There is no entitlement to a video being available at all times (e.g. without an internet connection or when Google is not serving an ad at that moment).
• If the AI does not recognise a car, our server cannot be reached or recognition is temporarily not possible because of a limit (see below), no scan is used up.

Android: The Android app currently does not offer ad videos. As long as this is the case, you cannot unlock scans and Car Duels there by watching a video; the points above on unlocking via video only apply on Android once the app offers ad videos. After the trial week, you continue scanning and playing Car Duels on Android with CarDex Pro. Your garage with all collected cards is kept even without a subscription.

CarDex Pro

With the optional CarDex Pro subscription, you continue to use CarDex after the trial week with all features and without ad videos: unlimited scanning (within the technical limits, see below), unlimited Car Duels, batch upload, higher-resolution photos, double base XP for every scanned car, a higher daily XP limit in the Car Duel (30 instead of 10 counted hits) and Pro badges.

• Prices (final prices incl. statutory VAT, Germany): in the Apple App Store, monthly subscription €4.99 per month, yearly subscription €23.99 per year; on Google Play, monthly subscription €5.99 per month, yearly subscription €28.99 per year. In other countries, the price shown in the respective store in local currency applies. In the App Store and on Google Play there is no free trial period and there are no introductory offers; the trial week (see above) is independent of this and free of charge.
• Purchase & payment are handled via the store from which you installed CarDex. On iPhone: via your Apple Account in the Apple App Store; Apple is the seller. Apple’s terms apply in addition. On Android: via your Google account on Google Play; your contractual partner for the purchase is Google Commerce Limited, Ireland. The Google Play Terms of Service apply in addition.
• Term & renewal: The subscription runs for one month or one year. Under the terms of Apple, with whom you take out the subscription, it renews automatically for the same period at the same price unless you cancel at least 24 hours before the end of the current period; Apple charges the amount for the new period to your Apple Account within 24 hours before that period begins. Under Apple’s terms, a price change for an ongoing subscription only applies after prior notice from Apple and, where required, with your consent. Mandatory statutory consumer rights, in particular regarding cancellation, remain unaffected.
  Android / Google Play: The subscription renews automatically for the same period unless you cancel. Google Play charges the amount for the new period to your Google account when that period begins, no earlier than 24 hours beforehand. Google Play informs you of a price increase in advance; under the Google Play Terms of Service, it applies no earlier than from the next payment that falls due at least 30 days after the notice and, where required, only with your consent.
• Cancellation: at any time with effect from the end of the current period, at the latest 24 hours before it ends – in the subscription settings of your Apple Account (iPhone: Settings → your name → Subscriptions) or directly in the app under Settings → “Manage / cancel subscription” („Abo verwalten / kündigen“). Pro remains active until the end of the paid period. Deleting the app does not end the subscription.
  Android / Google Play: at any time with effect from the end of the current period – in the Google Play app under profile picture → “Payments & subscriptions” → “Subscriptions” (also at play.google.com/store/account/subscriptions) or in the app under Settings → “Manage / cancel subscription”. To make sure no further renewal is charged, cancel at least 24 hours before the end. Pro remains active until the end of the paid period. Uninstalling the app does not end the subscription.
• Restore purchases: After changing devices or reinstalling, you can reactivate an existing subscription in the app’s Pro window via “Restore purchases” („Käufe wiederherstellen“) (same Apple Account or, on Android, same Google account).
• Technical limits: “Unlimited” means: the app itself does not set you any daily or monthly limit. However, recognition runs via an AI service from Google whose capacities (quotas) are limited. In addition, server-side limits apply to protect against misuse and disproportionate costs: currently a maximum of 20 scans per minute and 400 scans per day per internet connection or IP address, plus an overall daily limit for all users combined. If the AI service’s quota is exhausted or one of these limits is reached, scanning is temporarily not possible; no scan is used up in that case (see also section 7).

6. Right of withdrawal

iPhone (Apple App Store): Since you buy CarDex Pro via your Apple Account and Apple is the seller, withdrawal and refunds are governed by Apple’s terms. Under these terms, you can withdraw from an order within 14 days of receiving the invoice without giving reasons; for subscriptions, this applies to the initial purchase, not to automatic renewals. You declare the withdrawal to Apple, e.g. via reportaproblem.apple.com or the purchase history of your Apple Account. Mandatory statutory consumer rights remain unaffected.

Android (Google Play): If you buy CarDex Pro via Google Play, your contractual partner for the purchase is Google Commerce Limited, 70 Sir John Rogerson's Quay, Dublin 2, D02 R296, Ireland. Withdrawal and refunds are then governed by the Google Play Terms of Service and Google Play’s refund policies (support.google.com/googleplay/answer/2479637). You request a refund from Google Play, e.g. via your order history (play.google.com/store/account/orderhistory). If you have problems with a purchase, you can also contact us (info@car-dex.com). Mandatory statutory consumer rights remain unaffected.

7. Availability

We strive for stable operation but do not owe uninterrupted availability. AI recognition depends on the service of a third-party provider (Google) and its quotas. If these quotas are exhausted, the service is disrupted or one of the limits mentioned in section 5 is reached, scanning may be impossible at times – possibly even for several hours. In these cases, no scan is used up. Ad videos are served by Google; whether a video is available at any given moment is not up to us.

8. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act (Produkthaftungsgesetz). In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical of the contract. Essential contractual obligations are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you regularly rely and are entitled to rely. Otherwise, liability for slight negligence is excluded. For decisions you make on the basis of the non-binding market values, we are likewise liable only in accordance with these rules; the unlimited liability under sentence 1 remains unaffected in all cases.

9. Intellectual property

The app, design, texts and database are protected by copyright. Brand and model names mentioned are the property of the respective manufacturers and are used for description only; there is no connection with the manufacturers.

10. Changes & applicable law

We may change these terms with effect for the future if there is a valid reason for doing so (e.g. a change in the legal situation, new or discontinued features). We will inform you of material changes in advance, with reasonable notice, in the app or by notification. If you do not agree with a change, you can stop using the app at any time or cancel an ongoing subscription; the amended terms then do not apply to you. Changes that shift the balance between service and consideration to your disadvantage or that affect the main performance obligations (in particular the price and scope of a booked Pro subscription) are excluded from this; a subscription period already paid for remains unaffected by changes. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), to the extent permitted by law. Mandatory consumer protection provisions of your country of residence remain unaffected.
